Am I eligible to expunge my criminal record? That’s a very common question, and the answer depends on a few important factors.

In New Jersey, expungement is a legal process that allows you to have certain criminal records removed from public view. This can include arrests, charges, and even convictions, as long as you meet specific eligibility requirements.

First, let’s talk about arrests that did not lead to a conviction. If you were arrested but the charges were dismissed, downgraded, or you were found not guilty, you may be eligible to expunge that record. In many cases, you can apply for expungement right away, depending on how the case was resolved.

If you were convicted of an offense, eligibility depends on the type of offense and how many convictions you have. For example, many disorderly persons offenses, which are similar to misdemeanors in other states, may be eligible for expungement after a waiting period.

Indictable offenses, also known as felonies, may also be expunged, but there are limits on how many convictions you can have and how serious the offenses were. Certain crimes, such as very serious violent offenses, are not eligible for expungement under New Jersey law.

Waiting periods are another important factor. Depending on your record, you may need to wait several years after completing your sentence, including probation or parole, before you can apply. In some situations, early pathway expungement may be available, allowing you to apply sooner.

Your entire criminal history is considered, not just a single charge. This means the court will look at the total number of arrests and convictions on your record when deciding whether you qualify.

Expungement can make a big difference. Once a record is expunged, it generally does not appear on background checks, and you can legally answer “no” when asked if you have been arrested or convicted, with some limited exceptions.
